developing news. president obama on the ground in michigan right now starting the week right where he left off last week. using the public to pressure republicans in to extending tax cuts for the middle class to avert the fiscal cliff. these are some live pictures of a diamler plant outside of detroit where the president will be speaking in a couple of minutes. the president greeted by the state's republican governor about an hour ago. one day before a controversial right to work bill the white house is opposed to is signed in to law. we'll have more on that later in the show but as far as the fiscal cliff, our first read team says we are already at the end game if the goal is to get a deal passed by december 21st. now that means the president and house speaker boehner have five days max to reach an agreement. that takes us to the 15th. then the legislation has to be written by the 18th. the president is now working two strategies to get a deal done. he met with speaker boehner yesterday. that's the first face to face in nearly a month and their one on one first one since july 2011. n

the characterization of round 2 of obama care with the supreme court upholding it. you're right the supreme court upheld obama care. what the states rights will point to sleeper strands in that opinion that are pro states rights. chief justice roberts for a majority of the court said it violates congress's power under the commerce clause. he's placing real restrictions on the commerce power which has been the ace through which the federal government exerted authority over the nation. second, there are real restrictions placed in the restriction clause rather than the individual mandate. that spending clause restriction is going to be significant. these are seeds to not be too much of a conspiracy theorist that the supreme court is planting that it expects to grow in the future. people who are concerned with state's rights are reading that opinion saying we have allies in the supreme court now. we can do more. >> it's part of why the reelection of president obama was so critical was because we're looking at potentially two more supreme court justices in the next four years. hold on t

obama's trip to michigan comes at the same time that right to work legislation is teed up to be signed into law this week. the republican state house and senate jammed through the legislation last week and governor rick schneider who is also a republican, is likely to sign it tomorrow. labor union leaders say they've been told the president will address the right to work fight in today's speech in michigan. in a statement released last thursday a white house spokesman said that president obama has been opposed to right to work laws for a very long time. and that the strength of autoworkers in michigan is proof of how the unions help to build the economy and strengthen the middle class. right to work laws make it illegal for unions to automatically deduct dues from payrolls and people who support the law say that workers shouldn't have to be part of a union if they don't want to. but what really happens is nonunion workers benefit from a unionized workplace without having to financially contribute. ultimately, the laws end up cutting into union financing and weakening their bargaining p
